Please read these Terms of Service ("Terms") carefully before using The Clock Point application and website (the "Service") operated by Theroglabs LLC ("we," "us," or "our").

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. You must be at least 18 years old to use the Service.

2. Description of Service

The Clock Point is a time tracking and mileage logging application designed for contractors, delivery drivers, and service professionals. The Service allows you to:

  • Track work hours with clock in/out functionality
  • Log business mileage for tax deduction purposes
  • Generate reports and export data
  • View work history in a calendar format

3. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly update any information that changes
  • Accept responsibility for all activities under your account

4. Subscription and Payment

Free Trial

New users receive a 7-day free trial with full access to all features. A valid payment method is required to start the trial. You will not be charged during the trial period.

Subscription

After the trial period, your subscription will automatically begin at $2.00 per month. Subscriptions are billed monthly and renew automatically unless canceled.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months.

Price Changes

We reserve the right to modify subscription prices. Any price changes will be communicated to you at least 30 days in advance and will take effect at the start of your next billing cycle.

5. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Upload malicious code or content
  • Impersonate any person or entity
  • Use the Service to harass, abuse, or harm others
  • Resell or redistribute the Service without authorization

6. Your Data

Ownership

You retain ownership of all data you enter into the Service, including time entries, mileage logs, and any other content you create.

License to Us

By using the Service, you grant us a limited license to store, process, and display your data solely for the purpose of providing the Service to you.

Data Export

You may export your data at any time using the export features in the Service. We recommend regularly backing up your data.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Theroglabs LLC and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free. We do not warrant the accuracy of any mileage deduction calculations—you are responsible for verifying all tax-related information with a qualified professional.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEROGLABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or other harmful code transmitted through the Service

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Theroglabs LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Texas.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Theroglabs LLC regarding the Service and supersede any prior agreements.
